Lunovia Records is a music-focused digital ecosystem. In this document "Platform" refers collectively to the website, the mobile applications, the artist management tools and the content submission systems.
The Platform generally provides the following digital services:
This document does not replace an artist or distribution agreement. If a separate agreement has been signed between us, the specific provisions of that agreement are reserved and take precedence in respect of their subject matter. This document only sets the general framework for using the Platform.
Submitting a demo does not by itself mean that an agreement has been formed, that your content has been accepted, or that it will be released.
The Platform's mobile applications are also covered by this document. If you obtained the application through an app store, that store's own terms may additionally apply. Functionality may differ between versions; the presence of a feature on the web does not mean it is available in the mobile application.
As an account holder you are responsible for:
Where necessary, Lunovia Records may request additional verification or documentation from the account holder. Such a request is limited to verifying the account or the submitted content.
If you believe your account has been accessed without authorisation, please notify us without delay at info@lunovia.com.tr.
If the information you provide is incorrect, incomplete, misleading or false, Lunovia Records may refuse the relevant transaction or temporarily restrict the account.

When you submit content to the Platform, you declare that:
Lunovia Records is not obliged to investigate the legal ownership of every item of content submitted by users. This provision does not remove Lunovia Records's own control and review processes; it only determines where responsibility for rights ownership lies.
Lunovia Records may review content submitted to the Platform from a technical, operational, legal, security, content and metadata perspective.
As part of that review, Lunovia Records may:
The fact that Lunovia Records carries out a review does not transfer your responsibility for rights ownership to Lunovia Records. A review does not mean that ownership of the content has been verified.
Lunovia Records may remove content from the Platform, or restrict access to it, in the following circumstances:
Where content must be removed, Lunovia Records will inform the relevant user to the extent possible. However, in some cases prior notice may not be possible due to legal obligations, security considerations or restrictions originating from third parties.
Lunovia Records may temporarily suspend an account in the following circumstances:
In serious or urgent cases, it is not mandatory to allow a cure period before suspension. In other cases Lunovia Records will seek to give the relevant user an opportunity to remedy the situation, depending on its nature.
A suspension is lifted where the underlying reason no longer applies, or where a review finds no breach.
You may request closure of your account at any time. Your request is recorded and reviewed as described in the Privacy Policy.
Lunovia Records may terminate an account in the following circumstances:
Where an account is closed, the parties' continuing obligations may remain in force according to their nature. In particular, financial obligations, the retention of records for evidentiary purposes and statutory retention obligations continue to apply after the account is closed.
Where Lunovia Records needs to conduct a review in relation to an account or content, Lunovia Records may request additional information, request documentation, temporarily halt the relevant transactions and restrict access.
The conduct of a review does not by itself constitute a definitive finding of breach or of a criminal offence. The purpose of a review is to clarify the situation.
Where a third party asserts a claim in relation to a user or to content on grounds of copyright, trade mark, personality rights, content ownership or other intellectual property, Lunovia Records may temporarily restrict the relevant content for the duration of the review.
During this process you may be asked to provide the necessary explanations or documentation. Information provided is used in assessing the claim.
Some functions of the Platform may depend on the infrastructure or services of third-party service providers. Examples include hosting, email delivery, authentication, analytics, distribution or similar technical services.
In respect of situations arising from an interruption, change or discontinuation in a third-party provider's own service, Lunovia Records's liability is limited to the extent permitted by applicable law.
Which data is transferred to which service providers is explained in detail in the KVKK Disclosure Statement.
Lunovia Records does not warrant uninterrupted operation, error-free operation, continuous availability, any particular outcome, any particular level of revenue or any particular level of performance in respect of the Platform.
This provision may not be construed so as to remove rights arising from mandatory rules of law, including consumer legislation. Mandatory provisions are reserved.
Transactions on the Platform may be recorded by the system for the purposes of providing the service, security and evidence. Such records may in particular include:
These records are retained in accordance with applicable legislation and for as long as is necessary for their purpose. Details of what is recorded and how it is retained are explained in the KVKK Disclosure Statement.
All rights in the following belong to Lunovia Records:
You are granted only a limited right of use necessary to use the Platform in accordance with these terms. That right is non-transferable and does not extend to reverse engineering, copying or creating derivative works from the Platform.
Ownership of content submitted by users remains with the user, subject to any separately signed agreements.
In order to operate the Platform, Lunovia Records is granted a limited authorisation in respect of the content you submit, to the extent necessary to carry out the following:
This authorisation is limited to the purpose of providing the service and does not transfer your rights in the content to Lunovia Records. Content you submit does not become the property of Lunovia Records.
Rights relating to distribution, licensing and revenue sharing are not governed by this document; where applicable they are governed by the separately signed artist agreement.
To the extent that applicable law permits limitation, Lunovia Records limits its liability for damages arising from the following:
This section does not exclude Lunovia Records's liability arising from intent or gross negligence, nor liability arising from mandatory rules of law, including consumer legislation.
These terms may be updated from time to time. For each version, the version number, effective date and last updated date are published at the top of this page.
For material changes, notice will be given as required by applicable legislation. Such notice may be given by means of a notification shown in your account or a message sent to your registered email address.
These terms are governed by Turkish law.
For users who qualify as consumers, mandatory rules concerning the jurisdiction of the courts at the consumer's place of residence and of consumer arbitration committees are reserved. This section may not be construed so as to restrict a consumer's statutory avenues of recourse.
For users who do not qualify as consumers, the courts and enforcement offices of İzmir, Türkiye shall have jurisdiction over any dispute.
